upreme Court will hear a petition today challenging the Other Backward Class (OBC) quota of
27% and the EWS reservation of 10% for admission to postgraduate (PG) medical seats through NEET.


The petitioners in this case are seeking to overturn a July 29 notification that announced a 27%
reservation for OBCs and a 10% reservation for EWS in the all-India quota (AIQ) beginning in the
2021-22 academic year.
NEET PG counselling for 50% AIQ seats was supposed to start on October 25, 2021. MCC, on the
other hand, had postponed the counselling sessions. A bench of Justices DY Chandrachud, Vikram
Nath, and BV Nagarathna conducted the most recent hearing. With this, an affidavit was also
presented to the SC, stating that the counseling procedure would be halted and that the same
income criteria will be used to determine EWS and OBC candidates’ eligibility.
The Supreme Court had asked the Centre to clarify what process it used to determine the Rs 8 lakh
yearly income threshold for the EWS group.
The Centre had explained to the Supreme Court on October 26 that the Rs 8 lakh annual income cap
set for calculating the Economically Weaker Sections (EWS) category for reservation in NEET
admissions for medical courses is logical and in compliance with Articles 14, 15 and 16 of the
Constitution.
