A total of four judges of the Supreme Court have reserved 10% of seats in admissions and jobs for economically weaker sections of society.
Justice Dinesh Maheshwari stated that reserving a certain section for EWS (Economically weaker sections) does not violate any norms of the constitution.
Justice Bela Trivedi additionally supported Justice Dinesh Maheshwari on this statement. He does not see the 103rd Amendment as violating the basic structure or being discriminatory. He also argued that the operation of the 103rd Amendment was maintained and did not violate the basic structure of the Constitution.
The Centre already had proved before the Supreme Court that EWS reservation does not disobey the basic structure.
Jahit Abhiyan’s issue was challenging the constitutional validity of the 103rd Amendment to the 2019 Constitution. The measure allowed states to withhold higher education and public employment issues on an economic basis alone.
